What if My Plans Change and I am unable to move into the property?

If you decide not to take the property and have not yet signed a tenancy agreement then you would lose your administration fee and the holding deposit that you have already paid. If you have signed a tenancy agreement then you would have to find a suitable replacement for your flat/room and you would be responsible for any rent payments until a replacement is found.

What if I just walk away?

Walking away or posting the keys through the letterbox is called ‘abandonment’ and will not end your agreement. Your agreement will continue even though you’ve left and we can continue to charge you rent, so you’re likely to build up rent arrears: if your agreement is fixed term, you can be charged rent until the term ends if your agreement is periodic, you can be held liable until the agreement could have been ended by giving proper notice.

We can apply for a court order to make you pay what you owe. The court will decide whether you should have to pay the money or not. If we have managed to let out the property you will only be liable for rent up to the date that the new tenant moved in and started paying rent.

Can I find a replacement tenant?

This may be possible if you have no choice but to leave early and want to avoid paying rent on more than one home. We will also make efforts to find a replacement tenant.

However, you have to get our approval for the person you suggest to move into the property. They will need to pass credit referening, provide all documentation requested by us, pay a deposit and sign a tenancy agreement.

Covid Cancellation Policy for International Students

In these uncertain times, we understand that you may be hesitant to book your University Accommodation, so to make this decision easier, Hive Accommodation and our landlords have made allowances over and above our usual cancellation policy to protect you and allow you to cancel/amend any booking made for the 2021/22 academic year, if any of the below apply:


1. World Health Organisation recommendations and decisions around Coronavirus advise that you do not travel.
2. Flights to the U.K. have been cancelled (Direct and Indirect).
3. Flexible booking - If you course is online and off campus, you can book now and defer your start date to either; the week of Monday December 18th 2021 or Monday 3rd January 2022. Your rent is payable upon booking and we will refund you, depending on the move in option you chose from the dates above.
4. You are unable to obtain a Visa to study in the UK. If you are already in the UK on a valid visa but your visa is revoked, you are still iable for any rents due under the terms of your tenancy agreement.
5. You are not accepted onto your UK study course (No place, No stay).

Covid Cancellation Policy for U.K. Students

If for any reason you decide to cancel you tenancy before your contract start date, we might be able to release you from your tenancy agreement. But only if these conditions are met:

1. You agree not to transfer or sublet the tenancy to anyone else without our written consent,
2. You find a suitable replacement to take a new tenancy agreement for the rest of your tenancy. This person must: be at least 18 years old and enrolled as a full-time student in a university close to the accommodation; enter into a tenancy agreement with us and pay all sums due within it; and provide a guarantor where reasonable, who must accept the terms and conditions set out in the tenancy agreement.

NOTE:

We can’t refund you until the student replacing you has taken over your room’s contract, signed the tenancy agreement, paid, and moved in.

Cancellations after you have moved in.

If you can’t find someone to take over your tenancy, you’ll be responsible for paying the full rent until the end of your tenancy agreement.

If for any reason you have leave during your contracted term for any reason (Domestic and International students), we might be able to release you from your tenancy agreement. But only if these conditions are met:

1. You agree not to transfer or sublet the tenancy to anyone else without our written consent,
2. You find a suitable replacement to take a new tenancy agreement for the rest of your tenancy. This person must: be at least 18 years old and enrolled as a full-time student in a university close to the accommodation; enter into a tenancy agreement with us and pay all sums due within it; and provide a guarantor where reasonable, who must accept the terms and conditions set out in the tenancy agreement.

NOTE:
